Russian family finally wants to be naturalized
A Russian-born man and his family have been living and working in Styria for many years. They want to become Austrians and meet all the requirements. Now they have to give up their previous citizenship. But after entering the Russian embassy in Vienna, father and son could be deported directly to the war zone in Russia ...
A native Russian (47) has lived with his family in Styria for many years. As an employee in a management position at a well-known company, he also pays taxes to the Austrian state. The man feels at home here and has no intention of ever moving back to his home country. He would therefore like to renounce his citizenship and finally become an Austrian, just like his wife and son.
The family has fulfilled all the requirements and has therefore now received a request from the Styrian provincial government to renounce their Russian citizenship. However, this final step is now becoming impossible for them. This is because they have to hand in their passports at the Russian embassy in Vienna. But that is exactly where the danger lurks.
From the embassy straight to the war zone?
Because the 47-year-old and his son have not yet done any military service. So there is a good chance that the embassy will take them directly to Russia to do their military service - which would take them straight to a war zone! Even if they had done their military service, they would now have to fear being taken to Russia to go to war.
This procedure is intended to provide clarity for many of those affected.
Anwalt Andreas Kleinbichler
The family has therefore now sought legal advice from Graz-based lawyer Andreas Kleinbichler. He is convinced that they should be granted citizenship. Under the above-mentioned circumstances, it is simply impossible to provide the competent authority with proof that citizenship has been renounced. Moreover, the authorities were aware at the time the decision was issued that it was impossible for his clients to enter the embassy. He has now lodged an appeal against the authority's decision. According to the law, citizenship can also be granted without leaving the previous nationality.
No proceedings are yet pending in Styria on precisely this issue. Although this problem affects not only the family, but also a number of other Russians and, of course, Ukrainians. The lawyer is therefore convinced: "These proceedings should provide clarity for many of those affected."
