13,000 euros won for janitor
A man from southern Burgenland was wrongfully dismissed while on sick leave. With the help of the Chamber of Labor, he has now been paid his outstanding claims.
The man from the district of Jennersdorf had been working as a janitor for a Styrian real estate company since October 2017. His job was to look after and maintain various residential buildings in the border region. When he fell ill in July 2023 and was unable to work, he was allegedly offered an amicable termination by the company.
Success after second intervention
However, Südburgenländer never agreed to this. The written notice of termination followed in September. His employment was due to end at the end of 2023. "Although our member didn't have much hope, he came to us anyway to have his claims checked," says Reinhard Jud-Mund, AK district office manager in Jennersdorf. And that was a good thing: After the second intervention, the employer settled all outstanding claims - 13,439 euros gross, which amounted to 9,128 euros net.
"The janitor's detailed working time records were also helpful," Jud-Mund explains. For example, the final statement initially did not take into account any leave replacement periods for outstanding vacation days. The new working year also began during the notice period, and with it new entitlements. "This case shows that it is always worth having everything checked by us," says Jud-Mund.
