Driver attacked police officer after crash
A 27-year-old man from Oberland had to answer to the Feldkirch Regional Court on Tuesday because he lost his temper after an accident. The sentence was severe.
The 27-year-old from Oberland already has four relevant previous convictions. He is now on trial for causing grievous bodily harm and resisting law enforcement. The starting point was a wild speeding spree through the city center of Feldkirch: on November 12 last year, the heavily intoxicated driver sped through the Montfort city at 120 km/h. The attempt by a police patrol to stop the speeding driver failed miserably. Thanks to a ditch, in which the man and his speedster landed shortly afterwards, the matter resolved itself. Miraculously, the speeding driver remains unharmed. His partner in the passenger seat escapes with a bruised leg and concussion.
When the four officers arrive at the scene of the accident to take his personal details, the defendant goes completely berserk. The 27-year-old fights back tooth and nail against the police officers' attempt to restrain him on the ground. Even in the holding cell, the man continued to rage.
"What you did that night was pretty massive resistance to state authority", commented Judge Christoph Stadler on the recordings from the bodycams of two police officers. "I don't know what was wrong with me that night, but I'm very, very sorry," the defendant then apologized.
Nevertheless, the case doesn't end lightly for him: he receives 15 months in prison, five of which he has to serve. The council awards two injured police officers 800 euros in compensation for pain and suffering and refers their further claims to the civil courts. Defense lawyer Andrea Concin has already announced that she intends to fight the sentence because she believes it is too severe. Public prosecutor Melanie Wörle also wants to appeal - in her case, however, to the detriment of the accused. The case is therefore now a matter for the Innsbruck Higher Regional Court.
