The difficult fate of a 59-year-old woman is occupying the justice system in Carinthia: She suffers from dementia, has to be cared for in a nursing home - and is now alone. Her husband has been banned from visiting her due to domestic violence and criminal proceedings are underway against her son. The academic is alleged to have sexually assaulted his own mother.

"When the son visited, she didn't seem happy afterwards," says a member of staff at a care home in Carinthia. There were repeated conflicts with the 39-year-old, an academic, especially because of the very close contact between the 59-year-old dementia patient and the Bosnian-born man. "He lay in bed with her, cuddled, kissed and tasted her, played love songs to her, she couldn't defend herself much - I just don't think that's right!"

"Groping of breasts and genitals"
Other colleagues in the home also observed the caresses, the intensity of which is said to have culminated in what prosecutor Ines Küttler accuses of sexual abuse of a defenceless person: "French kissing, groping of breasts and genitals. There is no doubt based on the witnesses!" The accused himself naturally describes everything differently: "I adore my mother, I cared for her at home for eight years before she could no longer do so and had to go into a home. I played old songs for her to remember, but I would never touch her indecently, that would be incest!"

Mother is not fit for questioning
He considers himself to be completely wrongly accused because he had constantly denounced care deficiencies in the home. He also objected to helpers taking his mother to the chapel. "She is Serbian Orthodox, that's not her faith." No one can ask what the woman still believes in today - she suffers from a severe form of Alzheimer's dementia, is not fit to be questioned and now has to live in a home without her family. The son is suspected of abuse and the spouse has been banned from visiting due to domestic violence. This is one of the reasons why Judge Gernot Kugi is meticulously searching for the truth. More witnesses will be needed soon. The trial has been adjourned for the time being.
