In a sensitive case against a Tyrolean man, the public prosecutor appealed against an original diversion without punishment. Now the 72-year-old has to pay, because the judge did not believe his excuses in the second round of the trial.

The charges were the same as in the first round of the trial in November: the 72-year-old allegedly demanded photos of the family's nanny in her underwear, otherwise he would intervene with the AMS and have her visa blocked. "She was simply part of the family, I was worried," he said, justifying his controlling behavior. The au pair from Madagascar had sometimes not come home for days or could not be contacted.

Instead of an earlier confession, now a different version
Little remained of the confession in November that he had sent lewd or at least cross-border WhatsApp messages. "I didn't do anything", he said several times.

According to the defendant, it was like this: "The nanny sent the accused messages to herself from our family cell phone." She had the PIN code for the phone, the defendant's wife testified. His wife vehemently denied that her husband might have been interested in the girl. "It was a completely normal working relationship," she said.

Reason for alleged "revenge" questionable
Judge Norbert Hofer had doubts and asked several times why the au pair should have done this. "Out of revenge", said the Tyrolean couple. His wife had forbidden her to go to Berlin. "Then she and her boyfriend simply fabricated the story against me," the 72-year-old accused her.

Judge Hofer did not believe this story. "What sense does that make?" he asked several times. The public prosecutor made a similar argument in his closing statement. But the defendant stuck to his new version of the story. He intends to appeal against the sentence - a 6,000 euro unconditional fine.
