“No comprehensible motive in the indictment”
The public prosecutor's office in Innsbruck has brought charges against the father of Leon (6), the boy who drowned in the Kitzbühel Ache in August 2022, for the crime of murder and the offense of pretending to commit a punishable act - the "Krone" reported. Now the 39-year-old's two lawyers are speaking out.
"We want to examine the indictment carefully and then decide whether we will object to it," announced Albert Heiss and Mathias Kapferer. From the point of view of the defense, the indictment only contains the already known accusations of the public prosecutor's office. This will be dealt with in detail at the trial. The fact that a large number of witnesses are to be questioned in the interests of clarification is in the interests of the defense.
"We have commissioned expert reports ourselves"
"We have commissioned our own expert reports on several of the allegations made by the investigating authorities and subsequently by the public prosecutor's office. We will present clear statements on various findings at the trial," say the two lawyers.
"There is no evidence in the results"
From the point of view of the defense, what is missing in the entire indictment "is a comprehensible motive that the father should have had. The defense is also unable to comprehend the accusation of a long-planned crime. From the lawyers' point of view, there is no evidence of this in the investigation results," emphasizes the duo.
The indictment now available will be examined in detail and a decision will then be made as to whether an objection will be lodged within the 14-day deadline.
